1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and KDJ Lanka (Pvt) Ltd ("we," "us," or "our"), concerning your access to and use of our website (www.kdj.lk), mobile applications (including KDJ Singlish Android app), browser extensions (KDJ Singlish Chrome Extension), and AI-integrated applications including KDJ AI Chat, KDJ Cody, KDJ Shorts, and any future services (collectively, the "Services").

You agree that by accessing or using our Services, downloading our applications, installing our browser extensions, or creating an account, you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with these Terms of Service, you must not access or use our Services.

We reserve the right to update these Terms of Service at any time. Material changes will be communicated through our services or via email. Your continued use after such changes constitutes acceptance of the revised terms.

2. Eligibility and Account Requirements

2.1 Age Requirements

The Services are intended for users who are at least 13 years of age. By using the Services, you represent and warrant that:

• You are at least 13 years old
• You have the legal capacity to enter into a binding agreement with us
• Your use of the Services does not violate any applicable law or regulation
• If you are between 13-18, you have parental consent to use our Services

2.2 Business and Organizational Use

If you are using the Services on behalf of a business entity, organization, or educational institution, you represent and warrant that you have the authority to bind that entity to these Terms of Service and that the entity agrees to be responsible for your use of the Services.

2.3 Geographic Restrictions

Our Services are available globally, but certain features may be restricted in specific jurisdictions due to local laws or technical limitations. You are responsible for ensuring your use complies with applicable local laws.

3. Service-Specific Terms

3.1 KDJ Singlish (Web, Mobile App, Chrome Extension)

Our Singlish-to-Sinhala conversion service includes:

• Text Conversion: Real-time translation between Singlish and Sinhala Unicode
• Voice Input: Speech-to-text conversion (mobile app only)
• Chrome Extension: Integration with websites for seamless typing
• Offline Functionality: Basic conversion features work without internet connection

3.2 KDJ Cody (Code Editor)

Our interactive code editor provides:

• HTML, CSS, and JavaScript editing with real-time preview
• Code saving and sharing functionality
• Responsive design testing tools
• Educational resources and tutorials

3.3 KDJ Shorts (Educational Platform)

Our audiobook and educational content platform offers:

• Short-form educational audio content
• Multi-language support (English, Sinhala, Tamil)
• Progress tracking and learning analytics
• Downloadable content for offline learning

3.4 KDJ AI Chat

Our AI assistance service provides:

• Conversational AI support in multiple languages
• Educational assistance and tutoring
• Content generation and writing help
• Integration with our other services

4. Platform Distribution and App Store Terms

4.1 Google Play Store

For our Android applications:

• You must comply with Google Play Store policies
• Updates and installations are managed through the Play Store
• Refunds and billing disputes should be directed to Google
• App permissions are clearly disclosed in the Play Store listing

4.2 Chrome Web Store

For our Chrome Extension:

• Installation and updates are managed through Chrome Web Store
• Extension permissions are disclosed during installation
• You can disable or remove the extension at any time
• Data processing occurs locally on your device when possible

4.3 Direct Distribution

Some services may be available for direct download from our website. These are subject to the same terms but may have different update mechanisms and installation procedures.

5. Intellectual Property Rights

5.1 Our Intellectual Property

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, algorithms, translation engines, AI models, and the design, selection, and arrangement thereof) are owned by KDJ Lanka (Pvt) Ltd, its licensors, or other providers of such material and are protected by Sri Lankan and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5.2 KDJ Trademarks

The following are trademarks of KDJ Lanka (Pvt) Ltd:

• "KDJ Singlish" and related logos
• "KDJ Cody" and related branding
• "KDJ Shorts" and associated marks
• "KDJ AI Chat" and related identifiers
• The KDJ logo and company branding elements

5.3 Limited License to Use

Subject to these Terms of Service, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Access and use our Services for personal, educational, or internal business purposes
• Download and use our mobile applications on your personal devices
• Install and use our browser extensions
• Create and save content using our tools (subject to our content policies)

5.4 Restrictions on Use

You may not:

• Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or content obtained from the Services
• Decompile, reverse engineer, disassemble, or otherwise attempt to derive source code from the Services, including our mobile apps and browser extensions
• Remove any copyright, trademark, or other proprietary notices from the Services
• Use the Services to develop competing products or services
• Access our APIs or services through unauthorized means
• Use automated tools to extract data from our Services without permission
• Republish or redistribute our translation algorithms or AI models

6. User Accounts and Data

6.1 Account Creation and Management

Some features of our Services may require you to register for an account. When you create an account:

• You must provide accurate, current, and complete information
• You must keep this information updated
• You may have one account per person or organization
• Account sharing is not permitted

6.2 Account Security

You are responsible for:

• Safeguarding your account credentials and password
• All activities that occur under your account
• Immediately notifying us of any unauthorized access or security breach
• Logging out from shared or public computers

6.3 Account Suspension and Termination

We reserve the right to suspend or terminate your account:

• For violation of these Terms of Service
• For suspected fraudulent or abusive activity
• If your account remains inactive for more than 2 years
• For legal or regulatory compliance reasons
• At our sole discretion with 30 days notice for non-violation terminations

6.4 Data Export and Account Deletion

You may request to export your data or delete your account at any time. Upon account deletion, we will remove your personal data as outlined in our Privacy Policy, though some anonymized usage data may be retained for analytical purposes.

7. User Content and Acceptable Use

7.1 User Content Definition

"User Content" means any content that you submit, post, upload, or share through our Services, including:

• Text you input for translation or conversion
• Code you write in KDJ Cody
• Comments, feedback, or messages you send
• Audio recordings or voice inputs
• Any other content you create or share using our Services

7.2 Ownership and License

You retain all rights to your User Content. By submitting User Content to our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content solely for the purpose of providing and improving the Services.

7.3 Content Responsibilities

You represent and warrant that your User Content:

• Does not violate any third-party rights, including intellectual property and privacy rights
• Complies with all applicable laws and regulations
• Does not contain malicious code, viruses, or harmful software
• Is not defamatory, fraudulent, or misleading
• Does not promote illegal activities or hate speech

7.4 Content Moderation

While we do not actively monitor User Content, we reserve the right to review, remove, or restrict access to any content that violates these terms or applicable laws. We may use automated systems to detect potentially harmful content.

8. Prohibited Activities

You may not use our Services for any unlawful purpose or to:

8.1 Technical Abuse

• Attempt to gain unauthorized access to our systems or user accounts
• Use automated tools, bots, or scripts to access our Services excessively
• Interfere with or disrupt the operation of our Services
• Upload or transmit viruses, malware, or any other malicious code
• Attempt to circumvent security measures or rate limiting
• Engage in denial-of-service attacks or similar disruptive activities

8.2 Content and Behavioral Violations

• Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• Submit false, misleading, or fraudulent information
• Violate intellectual property rights or privacy rights of others
• Distribute spam, unsolicited communications, or promotional content
• Share inappropriate, adult, or offensive content
• Impersonate others or misrepresent your identity or affiliation

8.3 Commercial Misuse

• Use our Services for unauthorized commercial purposes without our permission
• Resell, redistribute, or sublicense access to our Services
• Create competing services using our technology or data
• Extract or scrape data for commercial use without authorization

9. Service Availability and Performance

9.1 Service Availability

We strive to provide reliable service but cannot guarantee:

• 100% uptime or uninterrupted access to our Services
• That our Services will be error-free or bug-free
• Compatibility with all devices, browsers, or operating systems
• That data transmission will be secure or uninterrupted

9.2 Maintenance and Updates

We may:

• Perform scheduled maintenance with advance notice when possible
• Release updates to improve functionality, security, or performance
• Temporarily suspend Services for emergency maintenance
• Discontinue features or Services with reasonable advance notice

9.3 Third-Party Dependencies

Our Services may depend on third-party infrastructure, APIs, or platforms. We are not responsible for outages or issues caused by third-party service providers, including app stores, cloud hosting providers, or internet service providers.

10. Free and Paid Services

10.1 Free Services

Many of our Services are provided free of charge. For free services:

• We may discontinue free services with reasonable notice
• Support may be limited compared to paid services

10.2 Paid Services and Subscriptions

11. Disclaimers and Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

11.1 Service Quality Disclaimers

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the Services will meet your specific requirements
• Warranties regarding the accuracy of translations or AI-generated content
• Warranties that the Services will be uninterrupted, secure, or error-free

11.2 Translation and AI Accuracy

Our translation services and AI features are provided for convenience and assistance. We do not guarantee the accuracy, completeness, or appropriateness of any translations, AI responses, or automated content. Users should verify important translations and not rely solely on automated systems for critical communications.

11.3 Third-Party Content

We are not responsible for any third-party content, websites, or services that may be linked to or integrated with our Services. Any reliance on such content is at your own risk.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KDJ LANKA (PVT) LTD, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

12.1 Types of Damages

• Direct, indirect, special, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Business interruption or system downtime
• Cost of substitute services or products
• Damages arising from translation errors or AI inaccuracies
• Damages from third-party actions or content

12.2 Maximum Liability

In any event, our total liability to you for all claims arising from or related to your use of the Services shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 USD, whichever is greater.

12.3 Exceptions

These limitations do not apply to liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or intentional misconduct.

13. Indemnification

You agree to defend, indemnify, and hold harmless KDJ Lanka (Pvt) Ltd, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms of Service or our Privacy Policy
• Your use of the Services in a manner not authorized by these terms
• Your User Content or any content you submit through our Services
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations
• Any fraud or misrepresentation by you

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to conflict of law principles.

14.2 Jurisdiction

Any dispute arising out of or in connection with these Terms of Service, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

14.3 Alternative Dispute Resolution

Before initiating formal legal proceedings, we encourage you to contact us directly to seek resolution of any disputes. We are committed to working with users to resolve issues amicably when possible.

14.4 International Users

For users outside Sri Lanka, local laws may provide additional rights that cannot be waived by these terms. Nothing in these terms is intended to limit such rights.

15. Changes to Terms of Service

We reserve the right to modify these Terms of Service at any time. When we make changes:

• We will provide notice through our Services, email, or app notifications
• We will update the "Last Updated" date at the top of this document
• Material changes will be communicated at least 30 days in advance
• Your continued use after changes become effective constitutes acceptance
• If you disagree with changes, you may terminate your account

16. Termination

16.1 Termination by You

You may terminate your account and stop using our Services at any time by:

• Deleting your account through your account settings
• Uninstalling our mobile applications
• Removing our browser extensions
• Contacting us to request account deletion

16.2 Termination by Us

We may terminate or suspend your access immediately, without prior notice, for:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity (with prior notice)
• Legal or regulatory requirements

16.3 Effect of Termination

Upon termination, your right to use the Services will cease immediately. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will remain in effect.

17. Miscellaneous Provisions

17.1 Entire Agreement

These Terms of Service, together with our Privacy Policy and any additional terms for specific Services, constitute the entire agreement between you and KDJ Lanka (Pvt) Ltd regarding your use of the Services.

17.2 Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms of Service will not be considered a waiver of those rights or provisions.

17.4 Assignment

We may assign our rights and obligations under these Terms of Service without your consent. You may not assign your rights or obligations without our prior written consent.

17.5 Force Majeure

We will not be liable for any delay or failure to perform our obligations under these terms due to circumstances beyond our reasonable control, including natural disasters, wars, terrorist attacks, or government actions.
